For the purposes of these Terms and Conditions, the “Promoter” refers to Newport Festivals Foundation. The “Sweepstakes” refers to the 2023 Newport Folk Festival Survey sweepstakes named and the “Prize” refers to one (1) of four (4), three-day General Admission passes to the 2024 Newport Folk Festival.

PRIVACY & TERMS OF CONDITION

The Sweepstakes is also subject to the Promoter’s existing Privacy & Terms of Condition.

GENERAL TERMS

By entering or participating in the Sweepstakes, participants agree to be bound by these Official Terms, and by the decisions of the Promoter, which are final and binding in all respects. Sweepstakes Entities are not responsible for: (1) any incorrect or inaccurate information or technical failures of any kind, (2) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (3) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the administration of the Sweepstakes, the processing of entries, or the selection or notification of winners. Further, if, for any reason, the Sweepstakes is not capable of running as planned for reasons outside the control of the Promoter which, in the sole opinion of Promoter, may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or portion thereof), Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes (or portion thereof). Promoter also reserves the right at its sole discretion to disqualify the Entry of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any website operated by the Sweepstakes Entities; (b) using any robotic, macro, automatic, programmed or like entry methods, which will void all such entries; (c) violating these Official Terms or the terms of service, conditions of use, and/or general terms of any Promoter property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Sweepstakes Entities are not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize; participation in this Sweepstakes or in any activity or travel related thereto or from any interaction with, or downloading of, computer Sweepstakes information.

PARTICIPANT OBLIGATIONS

By participating in the Sweepstakes, you agree to be bound by these Official Terms and the decisions of the Promoter. By accepting the prize, the winner agrees to release and hold Promoter and its affiliates harmless from and against any and all losses, damages, rights, claims, actions and liabilities of any kind in connection with the Sweepstakes or receipt or redemption of the prize. The winner assumes all liability for any injury, death, or damage caused, or allegedly caused, by participating in the Sweepstakes or use or redemption of the prize. By submitting, each entrant represents and warrants that no third party’s consent or approval is required for such entrant to participate in the Sweepstakes, and in any case, the entrant will indemnify Promoter and its affiliates, and hold Promoter and its affiliates harmless from any claims to the contrary.

SWEEPSTAKES DEADLINES

All entries must be received by 12PM EDT on October 9, 2023. Four (4) winners in the United States will be selected at random by The Promoter on October 20, 2023 and the winner will be notified using the email they submitted to sign up for the Newport Folk Festival mailing list on or after this date.

ADDITIONAL TERMS & CONDITIONS

• By completing the sweepstakes entry form, users agree to receive updates and marketing communications from Newport Folk Festival, Newport Jazz Festival and Newport Festivals Foundation via any communication method provided.

• No purchase necessary. Winners will not be required to pay to enter the Sweepstakes.

• Entrants must be over 18 years old on the date of their entry.

• Employees of Newport Festivals Foundation, Newport Folk Festival and Newport Jazz Festival are not eligible to enter.

• Only one entry per person and per email address will be accepted.

• Each entrant shall enter the sweepstakes by completing the form which can be found online at this link or by requesting a paper version by sending a letter to: 2023 Newport Folk DICE Waitlist Sweepstakes, P.O. Box 650, Essex, MA 01929

• The Prize or Prizes will be awarded to a randomly selected winner(s) who will be determined by using a random number generator.

• The Promoter will not be held liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.

• To the extent permitted by applicable law, The Promoter’s liability under or in connection with the Sweepstakes or these terms and conditions shall be limited to the cost price of the Prize in question.

• To the extent permitted by applicable law, The Promoter shall not be liable under or in connection with these terms and conditions, the Sweepstakes or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.

• Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the promoter reserves the right to substitute that prize for a prize of equal or higher value.

• The name, address, email address and phone number of the winner must be provided to The Promoter if requested and will be shared to enable fulfillment of the Prize.

• In the event of unforeseen circumstances beyond The Promoter’s reasonable control, the promoter reserves the right to cancel, terminate, modify or suspend the Sweepstakes or these terms and conditions, either in whole or in part, with or without notice.

• The Promoter’s decision is final. No correspondence will be entered into.
